Florida motorcycle accident fatal for driver, passenger hurt

Most people would agree that motorcycles are dangerous. Any number of factors can lead to a motorcycle accident on Florida roadways that result in serious or fatal injuries. Nevertheless, each time a passenger rides on a motorcycle, the operator owes them a duty of reasonable care in ensuring that they arrive at their destination safely. The initial evidence from a recent fatal crash in Melbourne suggests that duty may have been violated.

The crash occurred at one minute before midnight on a Saturday night in the early part of June. The biker, reportedly 76 years old, was apparently headed in an easterly direction on a local roadway when the bike came in contact with a center divider that was elevated from the road. As the Harley Davidson returned to the road, both riders were thrown off of it.

The man was killed at the scene of the crash. The female passenger was rushed to a hospital. Fortunately, she is expected to survive her injuries, the nature and extent of which were not further detailed. Authorities reported that both riders were not wearing helmets. The crash remains under active investigation, though no timetable was provided to indicate when the inquiry may be completed.

The reason that the driver struck the divider was not immediately clear, though it would appear the man lost control of the Harley. The seriously injured woman is likely thankful she is alive. She also may face escalating medical costs and related expenses as a result of the motorcycle accident. Florida law affords her the right to seek reimbursement for those damages by pursuing a personal injury claim -- in this case against the estate of the deceased man and any other owner of the vehicle that he was operating.
